Student Account and Financial Responsibility
You agree that your student account balance is your responsibility. By registering for courses at NMHU, you are making a commitment to pay the tuition and fees associated with the registration. You further agree that you will pay the tuition, fees and other charges to your account, as described below, all of which are owed for an educational benefit and constitute an educational loan that may not be dischargeable in bankruptcy. See 11 U.S.C. §523 (a) (8).
Student Account – NMHU will process all of your student-related financial transactions through your account. The terms of this agreement apply to all purchases, charges, fees, fines, tuition, advances and loans made or obtained by you, made or obtained by someone else with your permission or on your behalf, or assessed to you in accordance with NMHU policies, by, from, or with respect to NMHU (collectively referred to as “Charges”) through your account, including, but not limited to the following:
Tuition, Mandatory Fees and Incidental Fees
Telecommunication or IT Charges
Return to Title IV (withdrawals)
Other Incidental Charges
You agree that any charge to your account for services or goods consumed or used by you or from which you received a benefit are authorized by you even if there is not a contract or other documentation for the particular charge at the time that the charge was made.
Promise to Pay – You agree to promptly pay all charges on your student account. All charges on your account shall be paid no later than thirty (30) days after the date of your monthly account statement. If you have entered into a separate agreement with NMHU for installment payments, late fees, service charges, installment option fees and interest shall be charged to your student account as specified in the separate agreement(s) you accepted or signed. If the amount due is not paid on or before the date due, you agree to pay a billing/late fee of $25 for each semester.
You agree that as a student, account information will be commutated through your NMHU student email account and/or other email accounts provided to NMHU for that purpose. You further agree that your payment obligations are binding whether or not you receive or access your electronic account statement, and whether or not your account is being paid by another person or entity. It is your responsibility to keep track of your account balance and pay amounts due prior to delinquency. You agree that it is your responsibility to pay all amounts charged to your account, plus any late fees, service charges, interest and costs of collection.
Account Limit and Collections – You agree not to incur Charges in excess of the amount specifically authorized by NMHU. Your account is not a secured credit account or a line of credit. You agree that NMHU is not obligated to extend any credit to you and that NMHU may at any time right to refuse to allow further Charges to be placed on your account, for any reason, at any time, regardless of the status of your account. You consent to NMHU or its contracted agents, at our option, to report favorable and/or unfavorable credit information regarding your account to credit bureaus and other appropriate
organizations. You agree to reimburse NMHU for all costs and expenses incurred by NMHU in attempting to collect amounts owed to NMHU from you, including reasonable attorneys’ fees and costs.
If your account becomes delinquent, your academic record will be placed on hold and NMHU will restrict access to your grades and/or transcript. Registration for future classes may not be processed and further Charges to your account may not be allowed until the account is paid in full.
If your account becomes delinquent after 180 days, NMHU may send your account to a collection agency or other legal authority for collection. The amounts due under delinquent accounts that have been turned over to a collection agency or other legal authority must be paid directly to that entity, except for NMHU’s costs of collection, which are paid to NMHU as follows. If your account is turned over to a collection agency or other legal authority, you agree to reimburse NMHU for the fees charged to NMHU by the collection agency or other legal authority, which may be based on a percentage (at a maximum of 40%) of the debt and all other costs and expenses, including reasonable attorneys’ fees, that NMHU may incur in such collection efforts. In addition, the collection agency or other legal authority may charge you for its costs of collection, including attorneys’ fees and, if a judgment is awarded to the collection agency, post-judgment interest in accordance with New Mexico law.
Any delinquency may be reported to the State of New Mexico and a hold may be activated that will prevent you from receiving any funds payable to you from any state agency, including without limitation any tax refund due to you pursuant to the New Mexico Tax Refund Intercept Program Act.
The enrollment action constitutes a financial obligation between you and NMHU and all amounts paid to you or on your behalf through your account pursuant to this agreement, and all charges to your account, will be used for educational purposes and constitute an educational loan pursuant to 11 U.S.C §523 (a) (8) and under the New Mexico Tax Refund Intercept Program Act, §7-2C-3 (E) NMSA. In addition to all other methods available to NMHU, you authorize NMHU, its schools and department, and their respective agents and contractors to contact you regarding your loan, student account or any balance owed to NMHU including repayment of your loan and student account at the current or any future number for your cellular phone or other wireless device, either provided or acquired, in any manner chosen by NMHU, including using automated telephone dialing equipment or artificial or pre-recorded voice or text messages.
I understand and agree that by signing this document, I am confirming my registration for the courses selected and accepting the terms of this agreement.
