Family Educational Rights and Privacy Act

What is FERPA

FERPA is the Family Educational Rights and Privacy Act of 1974, also known as the Buckley Amendment Statute: 20 U.S.C. § 1232(g), Regulations: 34 CFR Part 99. The law applies to all educational agencies and institutions that receive funds administered by the Department of Education.

The law protects students’ educational records and gives parents certain rights with respect to their children’s records until the child reaches the age of 18 or attends a school above the level of high school.

Below is a list of forms that apply to students and their parents.

Student Annual Notification: used to notify students annually of their FERPA rights.

Dependent Student Verification Form: used by parents of dependent students to verify that the student is claimed on the parents federal income tax so educational information can be released to the dependent parent without a FERPA release from the student.

Request for Educational File Review: for students to request a review of their educational record at Highlands.

Student Release of Information: allows any person designated by the student to have access to the student’s educational record at Highlands.

Confidential File Request Form: allows the student to control if their directory information is kept confidential and not released to third parties under the FERPA section 99.31 regulation. If students complete this form their directory information will only be released to third parties designated by the student in writing.
